Terms of Service
PEM Tracker · last updated 22 August 2026
By using PEM Tracker you agree to these terms. If you do not agree, please do not use the service. It is offered free of charge, by invitation, as a personal project.
1. Who may use it
- Access is by invitation. Accounts may not be shared or transferred.
- You must be at least 16 years old.
2. What the service does
It collects wearable measurements you choose to connect, plus a short daily questionnaire, and presents them as a dashboard with an estimate of post-exertional malaise risk. Detection thresholds are calibrated per person and require a meaningful history before they mean much. Early estimates should be treated as provisional.
3. Availability
The service runs on privately operated hardware, maintained by one person in their own time. There is no uptime commitment, no support obligation, and no guaranteed response time. It may be unavailable, interrupted, or discontinued at any time, with or without notice.
4. Your data
Your data remains yours. How it is handled is described in the Privacy Policy, which forms part of these terms. You may delete your account and its contents at any time.
4.1 Consent
Use of the service requires your explicit agreement to these terms and to the Privacy Policy, given at sign-in. That agreement is recorded together with the version of the documents you were shown.
You may withdraw it at any time, which stops further collection. Withdrawal is recorded alongside the original rather than replacing it. It does not by itself erase data already stored — use the delete option for that.
If these documents change in a way that materially affects what happens to your information, you will be asked to agree again rather than being carried over on the previous agreement.
4.2 Export
You can export your data at any time, in a machine-readable format, for as long as your account exists.
The export covers everything the service holds that did not come from your connected device — in particular your daily questionnaire responses, any notes you wrote, your personal calibration settings, and your PEM history. That is the material that exists nowhere else. Measurements read from your wearable can be retrieved again from Google, but what you entered here cannot be recovered from anywhere but here, so exporting it is treated as an obligation rather than a convenience.
You will be able to export before deleting your account, and are encouraged to do so — deletion is permanent and cannot be reversed.
4.3 Access to your data by the operator
The person who runs the service has administrative access to the machine and therefore the technical ability to read stored data. This is not hidden behind a claim of impossibility. Such access is limited to running, repairing, and securing the service, each occurrence is recorded, and you may request that record.
5. Acceptable use
Please do not:
- attempt to access another person's account or data;
- probe, scan, or attempt to bypass the authentication or rate limiting;
- upload content that is unlawful, or that belongs to someone else without their consent;
- use automated tools to place unreasonable load on the service;
- use the service to provide medical advice to others.
6. Suspension and termination
Access may be suspended or ended if these terms are broken, if the account is implicated in a security incident, or if the service is retired. Where practical you will be given notice and a chance to export your data first. You may stop using the service and delete your account at any time, for any reason.
7. No warranty
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted operation.
8. Limitation of liability
To the fullest extent permitted by law, the operator is not liable for any indirect, incidental, or consequential loss arising from use of the service, including lost data or health decisions made in reliance on it. Nothing here limits liability that cannot lawfully be limited.
9. Changes
These terms may change as the service develops. Material changes will be notified in the application, and continued use afterwards constitutes acceptance.
10. Governing law
These terms are governed by the laws of the Province of Alberta and the applicable laws of Canada.
